Malicous *** dog in upper middle class neighborhood running free!?

This man in our neighborhood lets his rotweiler run free and it broke our cats leg and killed him. What are the cops going to do if it ws on our properity and my neighbour saw it? I mean I don't want to have it killed cause I mean what if it was you dog right?
